Solidarity Alert: IFPTE Joins Labor Community in Condemning Union Busting at the FLRA

IFPTE was one of twenty-four labor organizations signing a letter to Representatives Cummings and Quigley requesting that the House Oversight & Government Reform Committee undertake an investigation into the decision by FLRA Chairwoman Colleen Duffy Kiko, “to unilaterally cease recognition of the Union of Authority Employees (UAE).”

The letter, which comes after the FLRA Chairwoman refused to recognize the UAE earlier this year, alerts lawmakers that union busting at the FLRA is, “antithetical to Congress’ determination that federal sector unions are in the public interest, and antithetical to the mission of the FLRA itself.” Read the full letter below.

Dear Chairmen Cummings and Quigley:

The Federal Workers Alliance (FWA) hereby requests a full investigation into the decision by Federal Labor Relations Authority (FLRA) Chairwoman Colleen Duffy Kiko to unilaterally cease recognition of the Union of Authority Employees (UAE).

Chairwoman Kiko’s decision is directly in conflict with Justice Department Office of Legal Counsel precedence, going back to 1980, which recognized the UAE as the exclusive bargaining agent for FLRA employees. The UAE has had nearly 40 years of conflict-free representation of FLRA employees, and the decision of Chairwoman Kiko to unilaterally cease to recognize a valid labor organization is antithetical to Congress’ determination that federal sector unions are in the public interest, and antithetical to the mission of the FLRA itself.

In recent years, the UAE has served its member by negotiating agreements to cover employees’ bar membership fees; enhance to employees’ performance review standards; and ensure that FLRA employees have representation on the job guaranteed to other federal workers.

Federal unions who appear before the FLRA, including the undersigned below, have grave concerns at such bold, anti-union animus being exhibited by the authority that is supposed to be effectuating federal workers’ rights.

This decision by Chairwoman Kiko cannot be separated from other Trump Administration policies targeting federal workers and their unions. As you are aware, President Donald Trump has pushed executive orders to limit government workers’ union rights and other protections. President Trump has also failed to nominate an FLRA general counsel, leaving the agency without anyone to prosecute unfair labor practice claims on behalf of federal employees, unions, and agencies for two years and counting.

The essential mission of the FLRA is to protect collective-bargaining rights for government employees, including employees at the Department of Defense, Veterans Affairs, and Homeland Security, among others. It is unacceptable, now, those rights are being denied to them.
