IFPTE Local 7 President Jeff Tanner Instrumental in Supreme Court Win for Federal Workers

Jeff Tanner, President of IFPTE Local 7, played a key role in the process and litigation that was recently decided by the Supreme Court of the United States dealing with federally employed dual-status technicians.

In a 7-2 ruling last week, the Supreme Court ruled that “dual status technicians” who are employed by the United States Department of Defense and support State National Guard functions do indeed fall under the Federal Labor Relations Act and enjoy all the due process rights and employee protections that apply to all other federal workers.  

Tanner, who was president of an AFGE local at the time the State of Ohio challenged the federal employee protections of his members, successfully filed multiple Unfair Labor Practices (ULPs) that ultimately led the state’s legal challenge that ended at the Supreme Court.

Tanner commented on the Supreme Court decision

“This case is from my old Local and started because management started to remove our members from dues withholding. The union I was president of at the time started the ULP’s against the State and won, but the Agency decided to take this further by challenging whether they were covered by the FLRA jurisdiction. I am pleased, obviously, to see this Supreme Court decision.”
